Temporary restraining orders during a divorce can cause emotions to become inflamed. At times the parties of the divorce will act out against each other. A restraining order may be requested and sometimes is a standing requirement of the court.

Property Division

The division of property throughout the course of a divorce is frequently a contested subject, depending mainly on the value of the marital estate. In Texas, unless the property in dispute was seperate property, the property is considered community in nature. There are many different types of property and assets that may be subject to division, including:

  • 410Ks and Retirement plans*
  • Homes
  • Personal property
  • Vacation homes
  • Real estate
  • Debts
  • Stock options
  • Automobiles

Our firm can draft and handle the filing of a Qualified Domestic Relations Order (QDRO) that governs the division of some retirement (401K) benefits granted in the divorce.

Spousal Support

A party may be awarded spousal support or spousal maintenance, if certain factors are met. Some of these factors include (but are not limited to) the:

  • Age of the party
  • Length of the marriage
  • Health of the party
  • Monetary contribution of the parties
  • Income potential and employment situations

Our firm can help you determine if spousal maintenance can be requested, how much spousal support may be paid, and for how long. If our firm determines that spousal support can be awarded we will draft and file the necessary request for spousal support as applicable, and if ordered we will draft the order to ensure enforcement of that support.

Issues Regarding Children

Divorces involving children must be handled in a way that protect the best interests of the children. Modifications

After an order related to a divorce or any family law matter (paternity, suit affecting a child) is entered with the court, any party wishing to change that order will need to go through the court in order to change the terms of the order. In most cases, a final order can be modified only if there has been a change in circumstances of one of the parties or children or a showing of harm.
